Biamp(R) Systems Pleased With Tenth Circuit Court of Appeals Reduction of Damages; Plans to Fully Comply With Ruling

BEAVERTON, OR — (Marketwire) — 08/10/11 — Biamp® Systems, a leading provider of innovative, networked media systems, today issued an official statement in response to the ruling of The United States Court of Appeals for the Tenth Circuit. On Monday, August 8, the Tenth Circuit Court issued an opinion affirming in part, and remanding in part a November 2008 jury verdict issued by a federal district court in favor of ClearOne Communications against Biamp. As a result, Steve Metzger, President, Biamp Systems issued the following statement:

“Although we are pleased the court has effectively reduced the size of the damages against Biamp on constitutional grounds and has denied the plaintiff-s cross-appeal for prejudgment interest, we are disappointed that the court chose to avoid consideration of important core issues Biamp raised during appeal based on procedural matters.

“We believe the opinion does not reveal what we know to be true — that Biamp has never, nor would it ever, knowingly participate in the misappropriation of intellectual property.

“As ardently as we disagree with the final outcome, we do accept that the legal process has run its course and we-re pleased to have the matter resolved.

“The award of damages to ClearOne will have no material financial impact to Biamp-s operations or its ability to develop or deliver product to its customers. Further, it has no impact whatsoever on the technologies used in our products.

“Our customers can feel fully confident that there will be no disruptions in their supply of Biamp products.”
