XRoads Networks Gets Favorable Order Against Fatpipe Networks Over Tampering and Spoliation Motion in Patent Lawsuit

IRVINE, CA — (Marketwire) — 01/31/12 — XRoads Networks, a leading provider of unified bandwidth management platforms, today announced the company has received a significant order against Fatpipe Networks India Limited in an ongoing patent lawsuit filed against XRoads in 2009.

The United States District Court in Utah found that Fatpipe had failed to produce logs which would have confirmed whether tampering had occurred within the appliances which it had obtained for testing. XRoads had argued that the results of the appliance testing would have shown the lack of basis in Fatpipe-s suit, but the evidentiary trail pertaining to Fatpipe-s alleged testing had disappeared.

The District Court has since thrown out all evidence and/or related evidence obtained by Fatpipe from any purported testing of the XRoads Networks devices by Sanch Data, Fatpipe-s CTO during this lawsuit. The court also found that Fatpipe could produce no evidence to confirm the testing that Mrs. Datta had claimed under oath. Court documents confirm that Fatpipe opened the appliances; in violation of XRoads- sales agreement.

In support of its ruling, the District Court noted that Fatpipe-s excuses or explanations for the problems with the logs were “fantastic speculation.” As a result of the misconduct of Fatpipe, the Court not only issued an exclusionary order as to the testing results but granted XRoads Networks significant fees and costs incurred in bringing the motion.

XRoads Networks, which is represented by John O-Malley of Newport Trial Group, is moving for summary judgment in light of this recent order as it believes that it does not infringe on any patents held by Fatpipe and that XRoads Networks technology was unique and superior to that used by Fatpipe.
