SmartMetric-s Patent Infringement Lawsuit Against Visa and Mastercard Set by the Court for a Hearing by Jury in September 2013

BAY HARBOR, FL — (Marketwire) — 01/09/13 — SmartMetric, Inc. (OTCQB: SMME) — Speaking today, The President and CEO of SmartMetric, Inc., Ms. Chaya C. Hendrick, said, “SmartMetric, Inc. is looking forward to its trial by jury against Visa and MasterCard for what SmartMetric alleges as serious infringement of its -464- Patent.”

The “464” Patent, issued by the United States Patent Office and owned in full by SmartMetric, Inc., deals with data cards such as smartcards that are inserted into readers and that are used to establish a connection with a network. Visa has announced that it has started issuing in the USA, such cards that are referred to in the industry as EMV Cards.

SmartMetric has argued in its motions before the Federal Court that Visa and MasterCard should be found guilty of infringing the SmartMetric Patent. The company, SmartMetric, Inc. is in the discovery phase of the Court proceedings and is waiting for the card companies to produce papers that so far they have sought to withhold from disclosure to the Company and its CEO, C. Hendrick. In what appears very strange indeed both Visa and MasterCard have claimed allowing SmartMetric and especially its CEO access to all of its information under discovery would be harmful to their interests. SmartMetric has objected to this withholding of information and only allowing the so called confidential information to be seen by SmartMetric-s Patent litigation lawyers. The first motion by Visa and MasterCard to exclude information under discovery was thrown out by the Court in a ruling by the Judge on December 3rd 2012. The card companies have refiled almost an identical motion that was rejected last December and SmartMetric has filed its objections to this new motion. We are now awaiting another ruling of the Court regarding this matter.
