ServerPronto Receives U.S.-EU Safe Harbor Certification

The U.S.-EU Safe Harbor program is a voluntary certification that guarantees a company is complying with the international data privacy guidelines the European Union established in 1998.

The European Commission-s (EC) Directive on Data Protection prohibits the transfer of personal data to non-European Union countries that do not meet the European Union “adequacy” standard for privacy protection. While the U.S. and the EU share the goal of enhancing privacy protection for their citizens, the U.S. takes a different approach to privacy than the EU.

In order to bridge these differences in approach and provide a streamlined way for U.S. organizations to comply with the directive, the DOC in consultation with the EC developed a “safe harbor” framework. The framework offers the information an organization would need to evaluate — and then join — the U.S.-EU Safe Harbor program.

Organizations that decide to participate in the U.S.-EU Safe Harbor program must comply with the framework-s requirements and publicly declare that they do so. To be assured of Safe Harbor benefits, an organization must self-certify annually to the DOC in writing that it agrees to adhere to the U.S.-EU Safe Harbor Framework-s requirements, which includes elements such as notice, choice, access, and enforcement. It must also state in its published privacy policy statement that it adheres to the Safe Harbor Privacy Principles.
